Terms of Service

Please read these terms carefully. They govern your use of Digital Guardian and explain what we do — and do not — provide.

These Terms of Service ("Terms") are a legal agreement between you and Digital Fraud Safety India Pvt. Ltd. for use of Digital Guardian (our digital fraud safety app and free web checker at https://www.digitalfraudsafe.in). Our top goal is to protect everyone from digital and other scams — and help everyone stay digitally safe. By accessing or using our website, APIs, or apps, you agree to these Terms. If you do not agree, do not use the service.

Plain-language summary: Digital Guardian provides free scam-checking tools for guidance only. We are not a bank, police force, or government agency. We cannot guarantee every scam will be detected or that every warning is correct. Always verify through official channels before paying money or sharing OTPs. See our Disclaimer for full details.

1. Acceptance of terms

These Terms apply to all visitors, users, and others who access the service ("you", "your"). They incorporate by reference our Privacy Policy and Cookie Policy.

We may update these Terms from time to time. The "Last updated" date at the top of this page indicates the current version. Material changes will be posted here. Continued use after changes constitutes acceptance where permitted by law.

2. Eligibility

You may use Digital Guardian if:

  • You are at least 13 years of age (or the age of digital consent in your jurisdiction)
  • You have the legal capacity to enter into this agreement
  • You are not barred from using the service under applicable law
  • You use the service for personal or household safety purposes (unless we agree in writing to B2B use)

If you use the service on behalf of a family member (e.g. helping a parent check a message), you confirm you have their permission to submit content describing their situation where applicable.

3. Service description

Digital Guardian provides scam risk assessment tools for informational and educational purposes. Depending on the tool you choose, you may submit:

  • Text messages, emails, or chat transcripts
  • URLs, QR-related links, or app download links
  • Phone numbers or caller scripts
  • UPI IDs, payment requests, or transaction context
  • Other content relevant to India-specific fraud patterns

We analyze submitted content and return outputs such as:

  • A numeric risk score and risk level (e.g. low, suspicious, high, critical)
  • Detected signals explaining why patterns matched
  • "Do NOT" guidance and recommended next steps
  • Reporting references where appropriate

Digital Guardian provides free web tools and rule-based analysis to help you assess scam risk before you act.

4. Current service limitations

When using Digital Guardian today, you acknowledge that:

We may improve or change service behavior as we test and grow. We will update these Terms and the Privacy Policy when we introduce accounts, persistent storage, or other material changes.

5. No guarantee of accuracy or safety

Results are estimates based on automated analysis. We do not guarantee:

  • That any message, link, person, or payment is safe or unsafe with 100% certainty
  • Detection of all scams, including new or highly customized fraud
  • Absence of false positives (legitimate messages flagged as risky)
  • Prevention of financial loss, identity theft, or emotional harm
  • That following our guidance will produce any particular outcome

When our rules find no strong scam patterns, we still do not claim something is safe. We indicate that we cannot confirm it is safe. Low risk means we did not match known patterns — not a certificate of trustworthiness.

Scammers evolve quickly. A clean result today does not guarantee safety tomorrow if new tactics emerge. Always use official apps, known phone numbers, and in-person verification for high-stakes decisions.

6. Not legal, financial, or emergency advice

Digital Guardian is not a substitute for:

  • Legal advice from a qualified lawyer
  • Financial advice from a registered advisor or your bank
  • Law-enforcement investigation or emergency response
  • Medical or mental-health crisis intervention

If you are in immediate danger, contact local emergency services. If you have lost money, contact your bank's fraud helpline and report at Contact (for helpline links) or cybercrime.gov.in.

We cannot recover stolen funds, freeze scammer accounts, or arrest individuals.

7. No government, bank, or brand affiliation

Digital Fraud Safety India Pvt. Ltd. is an independent consumer safety company. Digital Guardian is not affiliated with, endorsed by, or operated on behalf of:

  • Any government of India ministry, agency, or police force (CBI, ED, RBI, TRAI, etc.)
  • Any bank, NBFC, payment app, or UPI network operator
  • WhatsApp, Meta, Google, Apple, or other platforms except as ordinary users of open web standards
  • Any courier, e-commerce, or lottery brand mentioned in educational examples

References to real organizations in tool examples describe common impersonation scams — not partnerships.

8. Your responsibilities

When using Digital Guardian, you agree to:

  • Use the service only for lawful, personal safety purposes
  • Make your own decisions — our output is guidance, not a command
  • Verify important claims through official channels before paying or sharing OTPs
  • Not rely solely on our results for large financial transactions
  • Keep your devices and accounts secure independently of our service
  • Report impersonation of Digital Guardian if someone abuses our name

9. Prohibited uses

You must not:

  • Submit content you do not have permission to share (e.g. others' private messages without consent)
  • Abuse rate limits, scrape, crawl, or automate bulk checks without written permission
  • Attempt to reverse-engineer, decompile, or extract our rule sets or models
  • Probe, scan, or test vulnerabilities except through an authorized bug-bounty program
  • Upload malware, illegal content, or content designed to crash our systems
  • Impersonate Digital Guardian staff or misrepresent our results as official bank/government verdicts
  • Resell, white-label, or commercially exploit the service without a license
  • Use the service to harass, defame, or falsely accuse individuals without basis

Violations may result in IP blocking, termination of access, and referral to authorities where appropriate.

10. Content you submit

You retain ownership of content you paste into check tools. You grant us a limited license to process that content solely to provide the check, improve security, enforce rate limits, and (in anonymized form) improve scam detection rules.

You represent that:

  • You have the right to submit the content for analysis
  • Your submission does not violate third-party rights or applicable law
  • You will not submit OTPs, PINs, or passwords even though our forms do not request them

12. Fair use & rate limits

Free tools are offered subject to fair-use limits to keep the service available for everyone. Anonymous users are currently limited to 5 checks per day per IP address.

We may adjust limits, introduce queues, or require accounts to prevent abuse. Attempts to circumvent limits (VPN rotation, distributed bots, etc.) violate these Terms.

Future authenticated tiers may offer higher limits. Details will be published before launch.

13. User accounts (future)

When mobile apps and accounts launch, additional terms may apply, including:

  • Accurate registration information and safeguarding login credentials
  • Responsibility for activity under your account
  • Deletion requests via in-app settings or support
  • Family and trusted-contact features requiring explicit consent from all parties

Account terms will be presented at sign-up and updated here before launch.

14. Free tier, subscriptions & refunds

Core web safety checking is free. Optional paid features (e.g. advanced caller screening, family plans) may be offered via mobile app stores.

  • Paid subscriptions will be billed by Google Play or Apple App Store
  • Refunds follow the respective store's policies
  • Prices, features, and availability will be shown clearly before purchase
  • We do not charge users on the website to "unlock" or "verify" results

15. Intellectual property

Digital Guardian name, logo, website design, safety engine, rule sets, documentation, and original content are owned by us or our licensors and protected by applicable intellectual property laws.

You may:

  • Use the free tools for personal, non-commercial safety checks
  • Share result links using built-in sharing features
  • Quote brief excerpts with attribution for news or education

You may not:

  • Copy, modify, or redistribute our engine, rules, or bulk content commercially
  • Use our trademarks to imply endorsement without permission
  • Remove copyright or proprietary notices

16. Third-party links & services

Our site may link to external resources (government portals, banks, app stores). We do not control and are not responsible for third-party content, availability, or policies. Your use of third-party services is at your own risk.

17. Limitation of liability

To the maximum extent permitted by applicable law in India:

  • The service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, or non-infringement
  • We are not liable for indirect, incidental, special, consequential, or punitive damages, including lost profits, lost data, emotional distress, or financial loss arising from reliance on check results
  • Our total liability for any claim relating to the service shall not exceed the greater of (a) the amount you paid us in the 12 months before the claim, or (b) ₹1,000, except where law prohibits such limitation

Some jurisdictions do not allow certain exclusions — in those cases, our liability is limited to the fullest extent permitted by law.

18. Indemnification

You agree to defend, indemnify, and hold harmless Digital Fraud Safety India Pvt. Ltd., its directors, officers, employees, and agents from claims, damages, losses, and expenses (including reasonable legal fees) arising from:

  • Your misuse of the service or violation of these Terms
  • Content you submit that infringes third-party rights
  • Your misrepresentation of our results as official government or bank findings

19. Suspension & termination

We may suspend or terminate access immediately if we reasonably believe you violated these Terms, abused the service, or posed a security risk.

You may stop using the service at any time. When accounts exist, you may request deletion per the Privacy Policy.

Sections that by nature should survive (limitations of liability, indemnification, governing law) will survive termination.

20. Disputes & governing law

These Terms are governed by the laws of India, without regard to conflict-of-law principles.

Subject to mandatory consumer protection laws, courts in India shall have jurisdiction over disputes. We encourage you to contact us first at Contact to resolve concerns informally.

Nothing in these Terms limits rights you may have under applicable consumer protection legislation that cannot be waived by contract.

21. General provisions

  • Entire agreement: These Terms, Privacy Policy, and Cookie Policy constitute the entire agreement regarding the service
  • Severability: If any provision is unenforceable, the remainder stays in effect
  • No waiver: Failure to enforce a provision is not a waiver of future enforcement
  • Assignment: We may assign these Terms in a merger or acquisition; you may not assign without our consent
  • Force majeure: We are not liable for delays or failures due to events beyond reasonable control (natural disasters, outages, war, government action, etc.)
  • Language: English is the controlling language of these Terms
